My point is, as far as the law is concerned, you can't prove malicious intent based on the tags simply being for sale so I doubt there's anything the cops can do about it at this stage?

 

 

It has been put up here before.

 

It is an offence to have identification tags in your possession, not attached to the vehicle they belong to, unless you have good reason to do so.

 

Words to that effect anyway.

 

So basically its illegal.

Fines and possible gaol term are in the penalty units.

Couldnt be bothered searching for it again.

But its there in the legislation.

those plates are off the lc gtr indy orange in the stolen section

Maybe this one? So a car gets stolen then a set of plates show up for sale??? Surely the Police would want to investigate this?

My friend has the tags.  He is in Newy working.  He is a big strong angry West Aussie, and you guy's no what that means

 

Or the original owner has given up and decided to sell the tags?

Yeah thats what I was saying earlier. The original owner has had the car stolen, but he was still in possession of the tags. He has given up on ever seeing the car ever again so has decided to sell the plates?

Full pay out claim for theft means you don't have salvage rights

 

It stops people stealing their own cars and getting the cash.... then miraculously getting their cars found and expecting it back

I'm no lawyer but I would think that having plates removed to facilitate repairs on the vehicle would be a reasonable excuse? But you should of course be able to prove that you are in possession of that vehicle and that it is indeed being repaired?

 

You could try to argue that you removed the plates for safe-keeping, but if the vehicle was stolen without the plates attached you would then be required to destroy them anyway, so that excuse goes out the window.

 

Whatever way you look at it, having plates in your possession that are for sale is NOT a reasonable excuse!

You'd have to be a arse of a cop to arrest someone for that case and it'd get thrown out of court.

 

The law is there to stop rebirthing, the judge would look at all the circumstances and a cop would likely turn a blind eye to the guy that has a tag with a frame around it nailed to a beam in his garage. I would imagine at worst, he'd confiscate the tag and let the guy off with a warning but if a cop found a stack of plates and the guy had a shed full of cars in various states of rebuild that didn't belong to the plates; that'd be reasonable suspicion. It'd then be up to a judge, evidence presented, etc. as to the outcome in court.

I did mention as stated above the crimes act but they relisted and used the term memorabilia. Hope someone keeps records of sellers, if they end up back on a car they should be held accountable also.
