well agent 34 was at my new work shop last Saturday and I checked his box I built for him well over 2 years plus and I could not find a fault with his box but I did the labour for free I replaced 3 key ways new in it not that it needed it but to keep him happy and i reassembled his box and we had found that his linkages were  doggy and not supplied by me it had a bolt and nut on it which made it notchy in second gear so  I gave him the right pin and clip free I am not a crook TB and never was if you have an issue with my box I will stand by  my warranty please stop the witch hunt on me back off I am nothing like what you state ask agent 34 how my shop is now and my conduct  he will confirm I an not the shonk you say I am. and if you continue I will seek legal action on you for defamation I hope I am quite clear as your  bully tactics to hurt my business is un called for  the past is the past TB leave it there ok and the witch hunt ends now understand !!!!

Do your best - clearly you do not understand defamation laws.

More clearly, IMO you haven't a clue about talking the talk and walking the walk when it comes to quality workmanship, quality produce and standing behind the same let alone launching any civil action.

Previously you shifted blame and you lied; now you are threatening to pursue me civilly but yet chosen not to speak and seemingly ignore the raft and litany of evidence which contradicts your claims of good character and workmanship.

 

You just don't get it mate - this is now a long, long way from the cleanliness of your workshop, or from the how and what you do when rebuilding gearboxes.

This is about you claiming 'x' but delivering 'y' - in the case of Simon - he says he didn;t even get 'y' but rather 'zero', and funnily enough, there is not a denial of this allegation from you.

 

And so tell me Peter, how exactly do you stand-by the warranty you speak of, and by this, I mean both practically, philosophically and physically?

  • By philosophically I mean that to date there has not been a skerrick of interest from you regarding remedy for the issues raised these past few posts by me or others.
  • By practically I mean how does it actually work - terms, conditions and the like - you know, the important stuff which speells out the consumer and the vendor's obligations and rights?  
  • By physically I mean - do you send me replacements for those defective parts?  If so, where is the offer to do so in the above? 

And tell me also Peter, just how does the box get a warranty service from you exactly - Do I ship it to you? Who pays? Should I do this with your track record of repeated missed deadlines and whatnot?

I think not mate.

 

"I will stand by my warranty" - my arse you do - nothing more than jingoism, and an empty throw-away platitude from you Peter.

With your above and previous, someone reading this would think you would be on to this, and prepared to go above and beyond to remedy this mess - whatever needs to be done.

You and I know better though don't we Peter (a rhetorical question mate - look it up before you answer that)?

Sadly so do others it seems.

 

Finally Peter, my "bully tactics" as you term them do nothing to hurt your business;

  1. Not bullying - telling it how it is - not a threat, not a boast, not a unsubstantiated claim in sight nor a witch hunt by the very definition - 'exercising my consumer rights' is probably more apt a description - tell me though, heard of hypocrisy - that last line is nothing but threatening, but pretty sure this is what you intended and guess what mate - you missed the mark - sorry about that,
  2. There is nothing I can do to hurt your business mate - you can continue to point the finger wherever you want but this mess is down to you and you only.  Accordingly I do not resile from my previous comment that when asked I will warn folk to stay away from you - they don't deserve your conduct Peter no matter how much you rationalise we/they do, and
  3. I agree with you Peter; I am done with this.

Complaints: from whom exactly Red?

You reference things like this, then you as a Moderator IMO you should morally stump up to it - if folk won't go public on their concerns then their basis ought to be disregarded by you IMO and thereafter it should not be cited in public text by you - these are the rules of 'natural justice' if you are familiar with the term.

And do say, are these genuine and formal complaints as to inappropriate conduct or content (rule breaking) by myself or Peter Zitis, or are they about mere opinion of folk discerning they simply don't 'like' the flavour, goings on or sentiment herein, and yet nonetheless asking their opinions do not warrant public dissemination by you?

I fear the later.

If the former; is this the best folks have to whinge about - a couple of blokes having a stoush over a consumer rights issue - seriously this brings you out in the capacity of a moderator...?  And you give credence to this despite no such complaint being referred to me and I assume Peter Zitis by these faceless men either directly or via forum Mods as to breaches of rules (offensive conduct)?

If the later; why post this - to do so is ambiguous and confuses cowardly opinion of these faceless men with fact.

Most importantly; are the complaints substantiated: yes or no?

 

And I would also rhetoically ask where does the language, abuse, vilification and cowardice that goes on in this forum day in and day out from 'the usual suspects' compare to this thread?  The former being something that is something which I submit is warranting attention and threat of sanction of Modertaors considerably more than this.  Having said that - lock this thread by all means - like I said, I am over it, and likely the OP is over it as well (his question/s have been well and truly answered despite being seemingly disingenuous in hindsight I submit), and finally it is also likely is that Peter Zitis is just as much over it as evidenced by no additional posts from him despite being on-line only this afternoon.

 

Let me be clear Red; I am not into slagging you as a Mod - I genuinely and sincerly appreciate the role and contribution you and your fellow Mods make to forums of this ilk.

I will say however, that when you want to wield the big stick, it should be without fear, favour, malice or ill affection - citing unsubstantiated complaints which do not disclose conduct which breeches the rules of the forum as you did is not fair and just.

Sorry Datto - I will not say anything to Peter Zitis which is not in a public or recorded forum - his version of events has proven time and time again to be unreliable IME, and so it appears to others as well.  By no means will I, or should anyone else open themselves to allegations of inappropriate commentary by having conversations which the content cannot be substantiated - I reference Peter Zitis' threat to launch civil proceedings for defamation as evidencing the need for open and reliable disclosure in every circumstance.

And so if I rely upon the forum to record sad commentary then I ask that you please permit my conduct.

But yes, I agree - this has dragged on, and is going in circles.

I believe my views ad concerns have widely been raised and no further corro is necessary.

I think you need to harden up Slack - this is nothing compared to the stoushes that regularly occur here - try the VK Big Banger thread as but a very recent example.

I note neither yourself, Datto nor Red had issue with the argy and bargy therein but hey, RHIP right...

If this particular thread causes you a corporal hurt then;

1. I apologise,

2. I suggest that perhaps stay away form the evening news - there is more things affronting therein than herein, and

3. Recorgnise that you asked the question in the first place - you sought opinions.  To suggest you don't like what came back is pretty under-done by you in terms of appreciating the purpose and reach of a pubic enthusiast forum mate.

 

And so a room is not needed despite your suggestion that it is - see above commentary to Datto.

"Personal attacks" you say - none from me Slack - great care has been taken to ensure the issue is played and not the person notwithstanding substantial parts of my commentary goes to Peter Zitis' character and only because it is his character and not merely his workmanship which is under scrutiny - this is the point of this thread which to summarise; 'who can you trust to build you a M21 gearbox in Sydney?' or did you miss this?  Subsequently this drew my reply and mere opinion as to why one should not entrust their hard earned to Peter Zitis.  If this offends, is 'awkward' or 'out of hand' then please, disregard - you have bigger things that warrant your concern - 239 souls lost in the Southern Indian Ocean are entirely more important that what you, I or indeed anyone has to say herein.

 

But hey, you would be well served to revisit Simon's post (#47) as to having paid for a gearbox two years ago and being yet to receive anything - is this another example of a 'personal attack' by any chance, or would you think this outcome relevant to a member, and perhaps even yourself if you were contemplating purchasing a gearbox from Peter Zitis as it seems that you were?  IMO if you answer anything but the later then I suggest you are disingenuous despite profiting from the same - your post at #29 says as much.  I will say less cheekily; This the replies to your question which commenced this thread is about information and folk like myself and others exercising my/our right to free but accountable speech and our consumer rights - you courted this FFS!  Peter Zitis argued the toss and bought into it as is his right to do - it is now for the populace and indeed the membership of this forum to decide who's account is most reliable and to that end it would be repugnant of me to forecast a result and so will remain silent on the subject.

 

I will ask Slack, should it ever occur, please remind me not to offer you my solicited opinion on a given subject again.

As long as the forum is never brought into any legal proceedings due to someone threatening lawyers

And that no-ones attacking anyone without facts and even then they only state those facts 

Then I don't have a problem with people expressing views

But if it gets out of hand we have to act and remove the thread

And if you want everything in writing... theres this thing people used to use called paper.. you can try that too.

I'm going to say here exactly what i've said in a thread in general section on an exactly the same thing that is being "discussed" between some disgruntled customers and another company.

 

I'm SURE you have all put your grievances out there for all to see,

There is NO DOUBT in what anyone has said here, it is blatant for all to see just how angry you all are.

 

The company you are trying to get a resolution from has also put their 2c forward.

 

Now.

I see no gain in leaving this thread open further for more and more argy bargy to continue between the people.

 

It APPEARS that the company in question is making "some effort" towards "some kind of resolution", and i sincerely hope that for their business sake this can be done to the satisfaction of the disgruntled customers.

 

So I'm going to lock this thread, Simply because no further good can follow from this thread.

 

It is up to the customer to contact the company and to sort this shit out.

If it can't be done, then this thread is evidence for others searching the internet for similar works.

 

Good luck to all parties to get this sorted.
